Guide for Aliens Applying for House
Purchase or Family Member’s Residence Permit
I. Target Applicants
Expatriate
Chinese, aged 60 or above, purchasing house property in Shenzhen, and their spouses
with foreign nationality, as well as their children under the age of 18.
II. Application Conditions
The expatriate
Chinese aged 60 or above, consecutively living in China over 6 months, purchasing house property in Shenzhen, and their
spouses with foreign nationality, as well as their children under the age of 18.
III. Application Materials
(I) Fill
completely in Visa and Residence Permit Application Form and attach one
recently taken two-inch (35mm ×53mm) half-length, bareheaded and full-faced color photo with blue background to the form.
(II) Submit Receipt of
China Visa Photograph for Foreigners in Guangdong Province.
(III) Submit valid
international travel certificates, including Diplomatic Passport, Service
Passport, Passport for Public Affairs, ordinary passport, and other
certificates, as well as the copy of last VISA for entering China.
(IV) Submit Registration
Form of Temporary Accommodation for Visitors provided by the police station
in the residential place of Shenzhen for verification (in case of applicants
for extension or renovation of residence permit without changes in residential
address, such form need not to be submitted).
(V) In case of aliens aged
18 or above, the health certificate issued by Shenzhen Entry-Exit Inspection and
Quarantine Bureau must be submitted (in case of applicants for extension or
renovation of residence permit, such form need not to be submitted).
(VI) Submit certificate of
house property issued by Urban Planning, Land and Resources Commission of
Shenzhen Municipality for verification.
(VII) Submit certificates certifying
the applicants’ financial source or documents of financial guarantee or
financial self-guarantee notarized by public notary offices in China.
(VIII) For spouses with
foreign nationality, marriage certificate shall be submitted for verification.
(IX) For children
with foreign nationality, birth certificate or family relationship certificate notarized
shall be submitted for verification.
(X) In
case of post-registration of residence permit due to loss of passport, Confirmation
of Reporting the Loss of Passport is also required to be submitted.
(XI) Relevant
certificates which shall be submitted according to the requirements of the
public security organs.
IV. Notes
(I) The
aliens applying for house purchase
and family members’ residence permit should go through the process in person;
in one of the following cases, it can proceed by proxy:
1. For
those, aged 60 or above, or with illness, or with other special reasons, who can’t
renew the documents for themselves, such applicants may entrust Chinese
citizens they turn to, in a written manner. The proxies must submit the powers
of attorney of the aliens, their identity documents and copies for verification. Additionally, in addition
to the aforesaid application materials required to be submitted, for the
applicants disabled due to illness, the proxies shall submit the certificates
provided by the hospital at county level and above or the certificates provided
by the police station in the place where such applicants temporarily live, in
order to prove the authenticity of the case.
2 In case the applicants are
under the age of 18 or of incompetence, the application may be gone through by
curators. Such curators shall submit their identity documents for verification.
For the permits gone through by proxy, the handling authority
can request interviewing the applicants if necessary and make inquiries.
(II) Relevant documents
provided by overseas institutions shall be recognized by relevant Chinese embassy or verified by China Legal Service (Hong Kong) Ltd., and translated Chinese documents with
the seal of translation companies and the copies of business licenses of such
translation companies shall also be provided.
(III) In case the residence causes,
including marriage, family relationship, house property ownership and children
with foreign nationality under the age of 18 etc., are disqualified, divisions
of exit-entry administration of public
security organs will not accept the application for the extension of residence
permit for the original reasons.
(IV) Please fill out the
application form in black or blue-black ink. The copies shall be prepared with
A4 paper, and the aforesaid application materials required to be submitted
shall be bound in sequence.
V Handling Authority

VI Processing Period
(I) Five
working days after the application is received.
(II) For those deemed to be investigated
by Public Security Organs, time for investigation shall not be counted into the
committed processing period.
VII For Your Information
(I) The aliens living
in Shenzhen shall apply for Registration Form of Accommodation for Visitors,
to the police station in the residential place, within 24 hours after arrival.
In case of new VISA and residence permit, the applicants shall apply for changing the residence registration information at
the police station in the residential place. In case aliens can’t go through
residence registration, or not apply for residence registration to Public
Security Organs, or reside without valid certificates, punishment of warning or
penalty of 50 yuan to 500 yuan will be made by Public Security Organs. In case
with serious violation, Public Security Organs will legally shorten the residential
period in China or cancel the qualification for residence in China.
(II) For the aliens
holding 5-day Tourism VISA in Special Zone, Group VISA or the aliens allowing
entry without VISA by Chinese government, no VISA or residence permits shall be
accepted, except for force majeure. For the aliens who have ever held * VISA
within recent 3 months, no VISA or residence permits shall be accepted.
(III) For any changes in
residence causes, passport number, accompanies and the like, the holders of
residence permits shall apply for new residence permits to divisions of
exit-entry administration of Public Security Organs within 10 days.
(IV)
For the infants born in
China, it should be reported to divisions of exit-entry administration of
Public Security Organs within
one month after birth, to go through registration procedures and VISA shall be applied within 3 months.
(V)
Relevant laws you need
to know
1 Article 3 of the Nationality
Law of the People’s Republic of China stipulates that the People's Republic
of China does not recognize dual nationality for any Chinese national; Article
4 stipulates that any person born in China whose parents are both Chinese
nationals or one of whose parents is a Chinese national shall have Chinese
nationality; Article 5 stipulates that any person born abroad whose parents are
both Chinese nationals or one of whose parents is a Chinese national shall have
Chinese nationality, however, a person, whose parents are both Chinese
nationals and have both settled abroad,or one of whose parents is a Chinese national
and has settled abroad, has acquired foreign nationality at birth instead of
Chinese nationality.
Note: For children under the age of 18, the application for visas or
residence permits requires the examination of nationality per the aforesaid
law. The ones who are verified to have Chinese nationalities are required to go
through Entry-Exit Permit of the People’s Republic of China.
★2 In the light of the provisions in Article 26 of Law of The People’s Republic of China on Control of the Entry and Exit of Aliens: The authorities handling
aliens' applications for entry, transit, residence and travel have the power to
refuse issuing visas and certificates.
